Green Lents Community Tool Library (GLCTL)

Borrowing Rules and Disclaimer

1. Only residents of the following neighborhoods: Lents, Powellhurst-Gilbert, Montavilla, Pleasant Valley, Foster-Powell, Mt. Scott-Arleta, Brentwood Darlington, Mill Park, Hazelwood, Centennial and Glen Fair, and who are over the age of 18 years are eligible to borrow tools from the Green Lents Community Tool Library, hereafter referred to as GLCTL. Members will update information yearly. 
   
   
2. Borrowers must be a member of the GLCTL prior to borrowing tools. Registration includes verification of the borrower’s identity and home address.  We will need to see a valid government-issued photo ID and a utility bill, mortgage statement, lease agreement or similar, displaying a qualifying address.  Additionally, the borrower must fill out the GLCTL Borrower’s Agreement and sign the Waiver that is included in the agreement, in person at the library.
   
   
3. By taking possession of any item, the borrower is certifying that he or she is capable of using that item in a safe and proper manner.
   
   
4. Only the borrower is authorized to use GLCTL tools. The borrower shall not permit the use of items checked out to them by any other person. Family members, including spouses, must also be a Member of the GLCTL before using or checking out tools.
   
   
5. GLCTL tools are for personal use by owners or renters to repair or improve their own residences or businesses, and may not be used for commercial purposes (i.e. for for-hire contracting or trade work).
   
   
6. We at the GLCTL are your neighbors; we are not in any way tool experts.  This means we are not able to assess either the internal or the external condition of a tool, and by lending a tool to you; we are in no way claiming that the tool is safe for you to use. By signing this document, you are agreeing that neither we, nor our assigns or successors, can be held responsible for any injuries, deaths, property damage, or any other consequences of the use, or the transport, of our tools.
   
   
7. The borrower agrees that the GLCTL is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.
   
   
8. The borrower agrees that if any borrower tool is or becomes unsafe or in a state of disrepair, the borrower will immediately discontinue use of the tool and notify the GLCTL of the issue on return.
   
   
9. All tools borrowed are to be returned to the Library before the return deadline (one week after borrowing).  Tools may only be returned during GLCTL open hours. Late fines ($1/tool/week) will be levied for each item kept past the loan period.
   
   
10. To request a loan renewal you must contact the GLCTL before the return deadline. Permission may be granted, however the Library may need to refuse or limit renewals based on demand for those tools, and the amount of renewals already given (renewals are generally given once or twice). Renewals may be requested in person or by phone during Tool Library operating hours or by email to librarian@greenlents.org at any time before the return deadline.
    
    
11. All items are first come, first served. Tools cannot be reserved.
    
    
12. Borrower understands and accepts that in an effort to maximize availability of tools to all Members, GLCTL volunteers may send emails as a reminder when borrowed tools’ return dates are approaching.
    
    
13. Items are to be returned clean and in the same condition as they were issued barring normal wear and tear.  The borrower agrees to pay for the loss of damage to any item and further agrees to accept GLCTL volunteers’ assessment of condition of items and to further agree to GLCTL volunteers’ assessment of fair restitution for damage, dirtiness, delinquency and/or loss of items in part or in total.
    
    
14. When tools are not returned by the designated due date, the GLCTL will issue an overdue notice by phone call, SMS message, (text), email and/or letter. If the tools are not returned after the notice has been sent, appropriate steps will be taken to retrieve them, including the use of a collection agency and/or legal action.  GLCTL may replace severely delinquent tools, holding borrower responsible for full replacement cost plus applicable handling and processing fees. Fines must be paid in full before borrowing additional items.
    
    
15. GLCTL retains the right to refuse to loan any item to any person for any reason whatsoever.

WAIVER AND INDEMNIFICATION

1. I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against Green Lents, the Community Tool Library, the Portland Development Commission, and the City of Portland for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the Green Lents Community Tool Library. 
   
   
2. I, hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless Green Lents, the Community Tool Library, the Portland Development Commission, and the City of Portland and their officers, agents, employees, and volunteers from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the Green Lents Community Tool Library.
   
   
3. I affirm that the above information is current, true and correct and may be subject to verification. I further state that I have read and fully understand the Borrowing Rules of the Green Lents Community Tool Library and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. I have read and agreed to this Waiver and Indemnification form, relinquishing any and all claims against Green Lents, the Community Tool Library, the Portland Development Commission, and the City of Portland.
   
   
4. I acknowledge that I have received and read a copy of the current Green Lents Community Tool Library Borrowing Rules and Disclaimer and agree to the terms and conditions therein.  I understand that these rules may be updated at the discretion of Green Lents.  The most current rules will be posted at the Green Lents Community Tool Library.
